Street Smart Shopper - Trading Terms & Conditions
Free connection & removal only applies to the areas designated as each states capital city limits. Connections are not available to any locations outside of this area. Free connections only applies for refrigeration and laundry products, this does not include the installation of dryer venting kits, wall brackets, dishwasher connection, fridge ice and water connections, cooking appliance installation, hot water & air conditioning installation nor does it apply to electrical, plumbing or any work normally considered tradesman like.
Street Smart Shopper guarantees a competitive market price policy and will match or better genuine prices on stocked items.
Some orders will incur a lead time. Lead times on these orders and out of stock items will be communicated after the order has been received by Street Smart Shopper. Should be unsure as to the lead time or cost of delivery for your area, then contact us on 1300 855 541.
If Street Smart Shopper makes an error with delivery or order processing, we will cover any costs required in resolving the error.
In regards to Credit Card purchases, identity will need to be established prior to or at the time of delivery. Street Smart Delivery Drivers may need to sight the credit card used for the purchase and verify the card holder/buyers identity to protect both the card holder and Street Smart Shopper from potential fraudulent activity. By purchasing any item by Credit Card, you agree to these terms and conditions.
If a model is purchased incorrectly it can be changed for another model before the day of delivery free of charge. Street Smart Shopper reserves the right to substitute superceded models with their direct replacement or a similar model. A similar model will only be shipped with the permission of the buyer.
Images on site may not reflect the actual model. Please refer to model number only. If a model is to be changed on its delivery day and the product is still in its original packaging there will be a $50 restocking fee to cover administration and re-delivery costs.
Please choose carefully as Street Smart shopper will not refund or exchange for ‘change of mind’ purchases once the item has been ordered from the manufacturer. Street Smart shopper reserves the right to refuse an exchange or refund on this basis. Should a decision be made to take the item back, then a 20% re-stocking and depreciation fee will apply.

TERMS & CONDITIONS OF SMART WARRANTY
A REFERENCE TO “YOU” IN THESE TERMS AND CONDITIONS MEANS THE CUSTOMER WHO PURCHASES THE SMART WARRANTY WARRANTY. REFERENCES TO “WE” OR “US” MEANS STREETSMART SHOPPER
1. WHAT THE WARRANTY COVERS
1.1 Scope of warranty. This Extended Warranty Plan (the Plan) is not an insurance policy nor is Streetsmart Shopper an insurer.
The plan is an extended warranty supplied by StreetSmart Shopper in respect of appliances (“Products”) sold by StreetSmart Shopper, under which StreetSmart Shopper’s obligations commence at the end of the manufacturers warranty period.
Please ensure that you keep your original purchase receipt and/or tax invoice to describe and validate your purchase of both your goods and this Plan. You may be required to produce these documents in the event of a claim. The warranty contained in this agreement does not commence until the manufacturer’s warranty expires. If a fault occurs in the Product during the manufacturer’s warranty period you should contact the manufacturer or the manufacturers nearest agent. For an explanation of the commencement date and expiration date, see clause 3 of this Agreement.
1.2 Assignment. The benefit of this warranty is for you only. You cannot transfer, assign or in any way give the benefit of this warranty to any other person or product.
1.3 Our obligations – Repair, Replace or Refund. Subject to the Terms and Conditions of this Agreement, which are set out herein and payment in full, by You of the price of this warranty, We will repair, replace or refund the purchase price of the product (the choice is Ours), if the Product fails to remain in good operating order during the Term of this warranty.
1.4 Your costs. Subject to clauses 4.14, 5.4 and 7.3 you do not have to pay the costs of repair or replacement apart from any applicable delivery and collection costs
1.5 Unless expressly provided for under this Agreement:
a) all terms, conditions, warranties and representation about the goods and services provided by US under this Agreement; and
b) any liability to Us, our employees or agents in negligence relating directly or indirectly to the supply of goods of services under this Agreement, are excluded EXCEPT THAT nothing in this Agreement shall be construed as excluding, restricting or modifying any statutory conditions or warranties (whether implied or otherwise) which are incapable of being excluded, restricted or modified, in particular those under the Trade Practises Act 1974 (Cth) or equivalent State legislation.
2. COST OF WARRANTY
2.1 You agree to pay the price of this warranty:
a) at the time you purchased the product; or
b) within any term we allow under a lay-by Agreement ; or
2.2 If you fail to make payments under clause 2.1:
a) this warranty shall have no effect and shall be terminated;
2.3 If we elect to give You a refund, you agree the We may retain that portion of the deposit or payment which represents the expired amount of the warranty calculated on a pro rata basis together with an administration fee of $25.00.
3. PERIOD OF WARRANTY
3.1 Commencement Date. This warranty Agreement commences on the date of purchase of the product. Our obligations under this Agreement commence the day after the manufacturers warranty for the related Product expires (subject, of course to you having paid the price of the warranty in full).
3.2 Expiration Date. Subject to clause 6, this warranty Agreement expires at the completion of the Term for your particular Product (refer to the table headed “Warranty Term” accompanying these Terms and Conditions).
4. WHAT THE WARRANTY DOES NOT COVER
Under this Agreement You are not covered for any damage or defect to the Product:
4.1 Insurance Policy. Covered by any household Contents insurance Policy.
4.2 No Fault Found. If no fault is diagnosed by our agent.
4.3 Excluded Events. Caused by circumstances or events detailed as Prescribed Events and Exclusions for policies of Home Contents Insurance under the Insurance Contracts Regulations pursuant to the Insurance Contracts Act 1984, i.e. including but not limited to, fire, explosion, liquids, or other foreign objects etc.
4.4 Vermin and Foreign Matter. Caused by infestation by vermin, or resulting from foreign matter entering the equipment, e.g. dirt, dust, heat and moisture.
4.5 Unauthorised Repair. Caused by repair work performed by persons who were not nominated by the manufacturer (while the product is under the manufacturer’s warranty), or who were not nominated by us.
4.6 Abuse, Misuse, Accident or Lack of Care. Caused by abuse, misuse, accident, a lack of care or negligence of your part or on the part of any third party.
4.7 Image Burn. Caused by image burn into displays, monitors, screens or CRT’s. This includes but is not limited to, burned phosphor including image, ghosting, pixels burnt out, or loss of pixels.
4.8 Manufacturers Instructions. Caused by your failure to operate the Product in accordance with the manufacturer’s published ratings, operating instructions, service or maintenance requirements, or by you doing anything which would invalidate the manufacturer’s warranty.
4.9 Injury to Person or Property. Or loss, or injury suffered by any person, goods or equipment (other than the Product) even if caused by defect or fault of the Product.
4.10 Notification. In respect of which we have not been notified by you, in accordance with Clause 5.1
4.11 Failure to Operate. Resulting from:
a) incorrect or improper installation; or
b) faulty antennae, poor reception or transmission problems; or
c) any interference external to the product; or
d) any modifications or alternations necessitated by teletext, cable or satellite or similar data transmission systems, video tape copyright protection systems; or
e) application of an incorrect or abnormal electrical supply or signal lead connection; or
f) a lightning spike or power surge; or
g) improper use of the product by you or any third party having regard to the nature of the Product and its inherent capabilities (eg, if a washing machine designed to take 5kg loads has been used for heavier loads and this has caused damage or defect, We are not obliged to repair, replace or refund the purchase price of the Product); or
h) defect in external wiring or in the electrical connection not forming a fixed a permanent part of the Product; or
i) any modifications or alterations necessitated by non-compatibility of ancillary equipment, or
j) the entry of a foreign object into the Product; or
k) corrosion caused by leakage of battery chemicals; or
l) resetting controls which have been wrongly adjusted whether accidentally or otherwise.
4.12 Manufacturer’s Repair. in respect of any repair, replacement, or recall by the manufacturer due to defective materials or workmanship by the manufacture in respect of which the manufacturer, supplier or any other person may be held liable.
4.13 Exterior/Interior Materials. or to the exterior or interior paint work or any materials used in the construction of the cabinet, chassis, doors, lids, door liners, control panels etc. or accessories of the Product. The includes but is not limited to, any damage to defect caused by rust, corrosion, or breakage, peeling or slitting or other defect or damage to either internal or external accessories of the product including the handles, shelves, baskets, internal doors or trays of, e.g. a refrigerator.
4.14 Repair or Replacement. Or in respect of damage to or defects in, or contributed by, any of the following items:
a) consumables, including but not limited to; batteries, globes, bulbs, toner, ribbons, ink cartridges, any filters, vacuum bags, consumer replaceable print heads, projector lamps etc.
b) all accessories, including but not limited to; any handles, trays, baskets, shelves, aerials, leads or cables, headphones, microphones etc.
c) any computer software or stored data.
d) Any computer hardware added after original purchase.
4.15 Servicing and Maintenance. or procedures required for ongoing reliable performance of the product including but not limited to:
a) cleaning of vents, filters, heads (audio/video/print) ant their associated tape paths; or
b) cleaning of removal of, any residue, foreign substance, or corrosion.
c) Removal of foreign objects, blockages or obstructions of any kind.
d) Reinstallation or recovery of software or data or removal of viruses.
4.16 Installation Costs. Or installation costs if we elect to replace the Product in lieu of repair.
4.17 Exclusion of Other Warranties. Which is covered by any other condition, representation, promise or statement made or imposed by us or others, apart from those incapable of exclusion.
4.18 Products located Overseas. Which occurs while the Product is located outside of Australia or its territories.
5. MAKING A CLAIM
5.1 Notify Us. If damage or a defect occurs within the Term of this Agreement you must notify us within 7 days of becoming aware of the damage or defect. You must ring our service line 1300 855 541 to notify us of the nature of the defect and your warranty details, plus any other information we may require.
5.2 Authorisation. By notifying us of a claim, you irrevocably authorize us to engage a repair agent to investigate the claim and perform any necessary repair work.
5.3 Deliver and Collect Product. If the product fits into a conventional sedan car, or its located outside our designated repair agent’s service area, you agree to deliver and collect the product, at your own expense, from the repair centre nominated by us or to pay for the reasonable costs of Our agent travelling to repair the product or collect the product for repair from you and delivering it back to you.
5.4 In Home Service. We provide an in home repair service for products which cannot be carried in a conventional sedan car and are located within our designated repair Agents service area. This service is available Monday to Friday (except on public holidays) between 9.00am and 5.00pm, or at a time agreed between you and our repair agent. If our repair agent is not available to gain access to the Product at the agreed time, you agree to pay the repair Agent’s time and travelling costs.
6. CANCELLATION OF WARRANTY
6.1 This Agreement will terminate automatically if.
a) you fail to make any payment when it is due; or
b) you make a fraudulent claim; or
c) we make a cash settlement or refund to you in lieu of repairs, or we replace the Product; or
d) the Product is used, or has at any time been used, for other domestic purposes; or
e) you fail to fulfil, or breach, the obligations imposed on you by clause 7.
7. OWNER’S OBLIGATIONS
7.1 Relocation. You must promptly inform us if the product is relocated to a different address than that applicable on the Commencement Date.
7.2 Time for Payment. You must make all payments which you are required to make in relation to the payment method you elect under clause 2.1 at the time they fall due.
7.3 Fault Not Covered Under Warranty. In the event that damage or a defect to the product is not covered by this Agreement for any reason, you agree that, upon notifying us of a claim, you will be responsible for paying the repair agent’s cost if investigating your claim and any subsequent costs of repair performed by the repair agent.
8. PRIVACY
You agree that subject to the Privacy Act 1988 (Cth). Personal information collected about you may be disclosed to credit providers, insurers, service providers including (without limitation) delivery companies, repair agents, mail searchers, debt collectors, claims processors and other advisers to enable them to perform those services.
